Elon Musk is continuing his legal battle against OpenAI over its shift to a for-profit company. However, he recently changed his complaint, stating he won’t personally seek any of the $150 billion in damages he’s pursuing. The Wall Street Journal reported that if Musk wins his upcoming trial, he wants any awarded damages to go to OpenAI’s nonprofit branch. He also aims to remove OpenAI CEO Sam Altman from the nonprofit’s board of directors if his lawsuit is successful.

Musk initially filed his lawsuit against OpenAI in 2024. He claims the company became a “closed-source de facto subsidiary” of Microsoft after dropping its nonprofit status. Consequently, he is now seeking a portion of the company’s current valuation, which he believes should benefit the remaining nonprofit side of OpenAI.
