The bad blood between Musk and OpenAI has simmered for years. Musk co-founded the organization as a nonprofit in 2015 alongside Sam Altman and several others. He left the board in 2018, but the split was far from clean. In a lawsuit filed in August 2024, Musk claimed that the company “assiduously manipulated” and “deceived” him. He argues that OpenAI abandoned its original mission to help humanity and instead became a secretive, for-profit machine closely tied to Microsoft.

Musk isn’t just looking for an apology; he wants a massive payout. His legal team argues that he deserves the value of the intellectual property created from his early contributions. U.S. District Judge Yvonne Gonzalez Rogers recently cleared the way for the trial to proceed in Northern California. OpenAI expects Musk to use his usual “harassment tactics” during the proceedings. They told partners that his comments are unlikely to be “grounded in reality.” Despite the looming courtroom battle, OpenAI insists it has a strong defense. They plan to focus on showing the jury that Musk’s claims are nothing more than a distraction. The trial marks the highest point yet in a rivalry that has defined the modern AI race.
